🚨Regulatory Update – Preliminary Opinions Procedure: Enhancing Transparency in Israeli Data Protection🚨

Israel’s privacy regulatory framework just took a significant step forward.

The Privacy Protection Authority has published a formal procedure for submitting requests for preliminary opinions under Section 17I2 of the Privacy Protection Law 5741-1981.

This move aims to provide clarity and legal certainty for data controllers and processors navigating compliance questions.

📌 Key highlights of the new procedure:

Who can apply: Preliminary opinions can be requested only by those who control or hold a database or are about to do so.

📝 What to include: Requests must include detailed legal questions, factual background, and a signed affidavit.

⏱️ Timelines: The Authority will respond within 60 days (extendable in special cases).

📢 Transparency: Opinions may be published, with or without identifying details, depending on the applicant’s consent.

🚫 Limitations: Requests will be rejected if they are theoretical, resource-intensive, or relate to ongoing legal or enforcement proceedings.

🔗 This new process empowers organisations to proactively engage with the regulator, reduce legal uncertainty, and align their data practices with evolving expectations.
